One year later, Touro Law Center’s TLC Heart Hotline is alive and beating. The Hotline receives an average of 10 to 15 calls a day from Super Storm Sandy survivers who continue to struggling to receive fair compensation for the devesatating (wind and flood) damge to their homes. Despite the historic extension of the Proof of Loss deadline from sixty (60) days to a year and a half, and the monetary grants of the New York Rising Program, the need for counseling to this population that still struggles to rebuild both their homes and lives is greater than ever.
The next step of the post storm recovery encompasses assisting callers in documenting the damage caused by the storm to homes and/ or businesses. Each Sandy survivor has particular damage to their home and/or businesses that must be specically and acutrately authenticated before recovering on a claim from FEMA direct or a private insurance carrier who is administering their claim. The situation as it has evolved has become extermely complex because of of inconsistencies within the flood insurance program itself, specifically the the staute of limuitation and its relation relationship to the proof of loss and the New York Rising Program and the SBA loan program. The result is a continuing influx of confused, angry and distraught callers.
